 User Agreement Acceptance of Terms: Before you attempt to sell or purchase any art through www.artnsoulinc.com, we require that you read and accept this User Agreement. By checking the box marked ‘Accept’, you hereby represent that you have read, understood and accept the terms and conditions of this User Agreement. Release: In the event that you have a dispute with one or more users, you release www.artnsoulinc.com, its officers, directors, agents subsidiaries and employees from claims, demands and damages of every kind and nature, known and unknown, suspected or unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Information Control: www.artnsoulinc.com cannot control the information provided by users. Users may find other user information to be offensive or inaccurate. Please use caution and common sense when utilizing this site. www.artnsoulinc.com makes every attempt to insure the originality of the work, however, www.artnsoulinc.com has no control of the legality of the art listed, the truth or accuracy of the listings or any information provided about the art or the artists. Listing Period: The maximum period for listing your art on www.artnsoulinc.com is one year. You may remove your listing from the site at any time. Buyer Liable for Purchase Price, Freight and Transportation Fees and Sales Tax: Buyer agrees to pay posted purchase price of the piece(s) of art, any insurance, packing, freight, shipping and applicable sales tax collectively. Payments: Payment for the art may be made by PayPal, money order or cashier’s check in U.S. dollars. Shipping & Packing: Seller shall pack the piece(s) of art and ship them to the address specified during the sale transaction. Piece(s) of art should be packed as to protect them during shipment. www.artnsoulinc.com shall not be liable for the packing and shipping process, and in no event shall www.artnsoulinc.com be liable for any damage arising from the packing or shipment of any art. Tax Responsibility: Title to the art does not pass to www.artnsoulinc.com. The seller shall file all sales tax returns in accordance with applicable law, and indemnify www.artnsoulinc.com against any tax, cost or expense relating to the failure of such sales tax liability related to the sale of such seller’s art. Tax Procedures: Upon registering, the seller shall specify the sales tax rate for the state in which it must pay taxes. If a buyer purchases a piece of art from a seller that resides in the same state, the seller shall charge the buyer sales tax at the rate of the state within which such buyer lives, and sales tax collected shall be passed on to the seller. Ownership Transfer: The art shall be and remain the risk of the seller, including freight and transportation costs, until it is shipped to the buyer, thereafter, the risk shall shift to the buyer. Return Period: A buyer of art has seven (7) days after the date of buyer’s receipt of sale to return the art. No returns will be accepted after this period. Commissioned art cannot be returned under any circumstance. Return Process: If a buyer elects to return a piece of art, the buyer must contact www.artnsoulinc.com customer support during the return period (email: jazzyjan@artnsoulinc.com). Assuming the returned piece of art has not been altered or modified and is returned within the return period, and www.artnsoulinc.com receives notification of seller’s acceptance of the returned piece of art, www.artnsoulinc.com shall debit seller for the purchase fees less any insurance, packing, freight and transport fees of the buyer’s purchase. www.artnsoulinc.com shall reimburse the buyer for the same amount within thirty (30) days of receiving verification that the seller’s account has been successfully debited. Reimburse shall be made by crediting the buyers’ account. Insurance, packing, and shipping with the return of the piece of art shall be the sole responsibility of the buyer and www.artnsoulinc.com shall have no obligation to reimburse buyer for such amounts. Remittance of Proceeds: www.artnsoulinc.com shall remit the purchase fees to seller within thirty (30) days after the shipment of the art to the buyer. A shipment tracking number MUST be provided by the seller to confirm delivery of art. Payments will be made to seller either by electronic transfer through www.paypal.com or by check. Third Party Links: Where www.artnsoulinc.com provides links to third party Internet sites, no endorsements are made in connection with such sites. www.artnsoulinc.com is not liable for anything arising from use of such sites. Service Integrity: www.artnsoulinc.com makes reasonable commercial efforts to make its services available at all times. However, www.artnsoulinc.com is not responsible for interruptions, including, but not limited to, interruptions that may affect the receipt, processing or acceptance of any aspect of a sale. Site and Services: The trademarks, trade names, designs and all material contained in all portions of the website, content, site design, text, graphics, and all intellectual property rights are the sole and exclusive property of www.artnsoulinc.com or its licensors. The use of any such property for any reason, on any other website, or the modification, distribution, or re-publication of this material without the written permission of www.artnsoulinc.com is strictly prohibited. Termination: This User Agreement constitutes a legally binding agreement between you and www.artnsoulinc.com until terminated by your or www.artnsoulinc.com, which www.artnsoulinc.com may do at any time. Limitation of Liability: In no event shall www.artnsoulinc.com be liable for any damage arising from a) any injury to any person or property caused by the art, b) any loss of revenue or lost sales due to the art. Amendment: We may, at our sole discretion, change, modify, add or remove any portion of your listing. Restricted Activities: Any information you provide during the registration, listing or sale/purchase process shall not: a) be false, inaccurate, or misleading, b) be fraudulent or involve the sale of fraudulent items, c) infringe on any third party copyright, patent, trademark, trade secret or other property rights of publicity or privacy, d) violate any law, statute, ordinance or regulation (including those governing export control, consumer protection, unfair competition, antidiscrimination, e) be defamatory, trade libelious, unlawfully threatening or unlawfully harassing, f) be obscene or pornographic, g) contain any viruses, Trojan horses, worms, time bombs, cancelbots, or contain computer program routines that may damage, detrimentally interfere with data or personal information, h) create liability for www.artnsoulinc.com (in whole or in part) the services of its ISPs or other suppliers; or i) link directly or indirectly to descriptions of goods or services that: i) are prohibited under this User Agreement; ii) are for sale on a website other than www.artnsoulinc.com, or iii) you do not have a right to link to. |
